Zamansky & Associates announces its investigation into the UBS Willow Fund sold to customers of brokerage firm UBS Financial Services over losses from trading in foreign sovereign Credit Default Swaps.

Zamansky is investigating whether the Willow Fund undertook risks by trading in foreign sovereign debt CDS that were not sufficiently disclosed to investors

Zamansky & Associates LLC announces an investigation on behalf of investors who purchased the UBS Willow Fund LLC (“Willow Fund”). The Willow Fund was a hedge fund which offered and sold more than $225 million in private placement interests to investors by UBS Financial Services Inc. to its brokerage account customers, according to its Reg. D filing on March 23, 2009 with the S.E.C. According to its 2009 financial statement filed with the S.E.C., the Willow Fund had over $400 million under management at its peak.

In a November 2012 SEC filing the Willow Fund disclosed that the Board of Directors approved the orderly wind down of the fund.

The Registration Statement filed by the Willow Fund with the SEC describes it primarily as a distressed debt fund engaged in analyzing investments for value opportunities. In its 2009 annual shareholder report, the Willow Fund reported suffering losses of $109 million from trading in credit defaults swaps (CDS) on foreign sovereign debt. According to Jacob Zamansky, “these losses resulted from gross deviations by the Willow Fund from its disclosed strategy and violations of its investment restrictions.”
