Morgan & Morgan Recovers $200,000 Verdict in Slip and Fall Case Against Publix

The court awarded $71,688 for past medical bills, $100,000 for future medical expenses and $31,000 in pain and suffering, plus attorneys’ fees and costs.

“In the days leading up to and during the trial, the defendant gave a zero-offer settlement,” said Mr. Smith. “I think the jury returned a very fair verdict and my client feels justice was served in her case.”

According to court documents, the plaintiff slipped and fell on a liquid nearby the cash registers at a Publix supermarket. The plaintiff claimed that she had to undergo a percutaneous discectomy as a result of the slip and fall, causing her to incur more than $70,000 in medical bills. The defense’s billing expert claimed that the plaintiff’s medical bills should have not exceeded $12,000, while their CME doctor said that the client was faking pain during his exam.

“The doctor they hired testified that she was able to do far more than she was telling him at the exam and that she did not appear to be in as much pain,” Mr. Smith added. “I think the jury clearly rejected that opinion when they came back with the verdict.”
