Workers injured on the job are legally entitled to be compensated. Claims often see unnecessary delays; however, according to attorneys with Doyle Raizner LLP, a law firm that focuses on ensuring workers receive fair payment for their injuries and damages.

Injury claims are typically addressed by their employer's insurance. If a claim is rejected, the worker can appeal to the state Industrial Commission of Arizona. But Mike Doyle, who focuses his practice on insurance bad faith cases, says the workers compensation system is controlled by the insurance industry, which doesn’t always follow the rules.

“Delays in paying out claims often lead to full-on denials,” Doyle said. “This can be a financial death sentence to an injured worker. If you're not able to work, and the compensation money never comes through, your entire family is threatened.”

Benefit payments are often delayed even when they're approved by the state, Doyle says. And if delays prevent medical treatments, it can lead to further injury.

“You and your workers compensation lawyer may have fought for the compensation you were owed in the first place, and finally won those benefits” Doyle said. “But, if your compensation has been unfairly delayed or denied, there is a greater harm there, even if you ultimately prevailed and won your benefits. Injuries can compound and become more serious because of delays and the lack of medical attention. We will pursue damages for lost work and new medical problems that could have been avoided had the insurance company simply honored its responsibility to pay up front.”

Raizner encourages any injured worker to contact an attorney right away if they feel their needs aren't being taken seriously.

“Your insurance company has a responsibility to you,” he said. “You did an honest job and worked hard, and you deserve proper care.”
