Chuck represented a young woman who was a passenger on a motorcycle heading westbound on U.S. 20 in Gorham Township, Ohio. The complaint states that the Defendant was operating her vehicle westbound on U.S. 20, activated her left turn signal, slowed down, began to make a left-hand turn, and suddenly readjusted and attempted to make a sudden right-hand turn onto County Road 19-2.
According to court documents there was a sudden collision between the motorcycle and the right side of the car. The car driver apologized after the car accident and acknowledged her responsibility for the collision. She later went on to change her story and claim that she was actually not at fault for the automobile accident.
The complaint filed with Wood County Court goes on to further state that Chuck's client suffered a personal injury to her left wrist and a small fracture in her low back and tailbone. She had incurred approximately $17,000 in medical bills, with a projected additional $18,000 in the future. The jury agreed with these medical costs.
The defense council in 12CV060 did not acknowledge the seriousness of the case. Even after significant and lengthy negotiations through court appointed mediation, the most that the defense offered to settle the case was $7,500. Chuck and the client agreed that this was insufficient compensation, especially in light of the at-fault party's $100,000.00 insurance limits and her initial admission of fault. Therefore, the decision was made to take the case to trial.
After a three day trial in the Wood County Court and significant jury deliberations, the jury came back and awarded Chuck's client $109,500.00 - more than 14 times what the defense had offered before trial!
