A Wallin & Klarich client, convicted of indecent exposure in 1999, was recently granted a certificate of rehabilitation and no longer will be required to register as a sex offender pursuant to California Penal Code section 290. The client was represented by experienced and knowledgeable defense attorney, Andrei Lapine.

According to court documents from Riverside County Superior Court, the client was convicted of indecent exposure in 1999 and as a result of his conviction the client was ordered to register as a sex offender for the rest of his life. The duty to register as a sex offender required the client to annually register with local law enforcement agencies and provide information about his whereabouts. In addition, according to the requirements under California Penal Code section 290.46, also known as Megan’s Law, the client had his name, address, and the fact that he was convicted of indecent exposure posted online and available to the public. The client sought out the assistance of Mr. Lapine of Wallin & Klarich to assist him in gaining a certificate of rehabilitation.

The petition explained that the client lived an upright life and exhibited good moral character and thus should be relieved of his duty to register as a sex offender. Mr. Lapine then filed the petition for a certificate of rehabilitation with the court. After reviewing the petition and the facts that Mr. Lapine presented, the District Attorney agreed that the client had been rehabilitated. The District Attorney then submitted to the petition and the judge granted the certificate of rehabilitation.
