A Wallin & Klarich client recently had his felony sex crime conviction crimes reduced to a misdemeanor. In addition, as a result of the reduction the client’s probation term, which was imposed because of the felony conviction, was terminated early and his record was completely expunged. The client was represented in the matter by experienced San Bernardino criminal defense attorney Hong K. Lyu, of Wallin & Klarich.

According to San Bernardino Superior Court record, the client was initially convicted of a felony sex-related crime and was placed on formal probation as a result. The client hired attorney Hong K. Lyu of Wallin & Klarich to assist him through the legal process and help him reduce the felony charge to a misdemeanor. The client was facing the prospect of living with a felony conviction on his record for the rest of his life. This conviction would bar him from owning a firearm, as well as from pursuing certain employment opportunities or educational or state licenses.

Mr. Lyu discussed the circumstances and history of the crimes with the client and then began to research what could be done given the circumstances, according to Wallin & Klarich. Mr. Lyu drafted and submitted to the court a pleading document that combined a motion to reduce the felony charge to a misdemeanor, to terminate the client’s probation early, and to expunge his record completely. After the court received the motion the District Attorney had the opportunity to review the document and decide whether or not to oppose the motion. On the designated hearing date at the San Bernardino Superior Court, Mr. Lyu appeared alongside the client before the judge. At the hearing, it was found that the District Attorney had no reason to oppose the moving document. Consequently, Mr. Lyu’s motion was granted in its entirety.

As a result of Mr. Lyu’s help, the client no longer has a felony conviction on his record. In addition, the client had his record entirely expunged of any criminal activity and does not need to carry out the full term of his probation. The client is now free to move forward without the burden of a felony conviction on his record.
