Atterro has taken a proactive approach to understanding the ACA through extensive analysis and has come to appreciate both the challenges and the opportunities that the Act presents to the staffing industry.
How ACA affects employers
The most significant regulations of the ACA are scheduled to take effect in January, 2014. The implementation of ACA can seem daunting to many employers seeking to understand and ultimately comply with the complexity of the law. Given the unique nature of the staffing industry, staffing employers, such as Atterro, will need to pay particular attention to the ACA requirements that relate to “pay or play” rules, “look-back” definitions, determining full-time status, identifying variable-hour employees, etc.
As it stands today, while many traditional staffing companies offer their eligible temporary workers a limited-medical or “mini-med” plan, the majority of these firms do not offer a major medical insurance option to these workers. However, beginning in 2014, firms with more than 50 full-time employees will need to decide whether to offer coverage that provides “minimum essential coverage” and is considered affordable to eligible temporary workers, or face paying tax penalties.

According to the National Center for Policy Analysis (NCPA), some employers will hire temporary or part-time workers to avoid the cost of providing health insurance. If wages and salaries remain fairly constant, but the cost of health care and retirement benefits grows, employers will be more likely to engage a temporary worker from a staffing agency. This gives an employer the flexibility to staff for demand, while avoiding the cost of having a permanent employee.
