Riverside child custody lawyer Sheldon E. Lee of Wallin & Klarich, recently assisted his client to file an ex parte motion to return his children back to the state of California. The client’s former spouse had recently removed the children from the state and the client was seeking to prevent losing contact with his children for an extended period of time.

According to Riverside Superior Court record, over Christmas break, the client’s former spouse had taken the children to Texas. When the school Christmas break ended, the client’s former spouse did not return the children to California to start the new semester. Since that time the client’s former spouse had kept the children in Texas and expressed that she had no intention of returning to California. The client sought out the help of family law lawyer Sheldon Lee to prevent the client’s former spouse from remaining in Texas and not allowing the client to see his children.

Mr. Lee knew that without immediate action it could be a considerable amount of time before the client would be able to see his children, as stated by Wallin & Klarich. Mr. Lee prepared an ex parte motion indicating to the court that the client’s former spouse had made a unilateral decision to move the children to Texas and keep them from the client. Mr. Lee presented evidence that showed that the California courts had jurisdiction over the matter because California was the children’s home state. Mr. Lee then further showed the court that the client’s former spouse had taken inappropriate action that was not in the best interest of the children and went against the client’s parental rights. The court ultimately held that the client’s former spouse had indeed taken inappropriate actions and should not have removed the children from the state.

As a result of Mr. Lee’s help, the client no longer has to worry that he will be unable to see his children for an extended period of time or that his former spouse has the ability to move the children without his consent. Most importantly, the client is able to remain involved in his children’s lives.
