Skechers Lawsuit Due To Serious Knee Injury
The complaint in this case (Case No. 3:13-cv-00164-TBR) alleges that the plaintiff bought Skechers Shape-Ups in June 2010 and soon began wearing these toning shoes while performing her daily activities. Nearly two years later, the plaintiff was walking in her Skechers toning shoes when her right foot turned inwards, causing her right ankle to painfully buckle; this, in turn, caused her fall down.

Upon seeking medical attention, the plaintiff was informed that she had torn the meniscus in her right knee. Initially, the plaintiff tried to repair her torn meniscus with minimally invasive treatments. However, the plaintiff ultimately had to undergo surgery and extensive physical therapy to try to repair her serious knee injury. To date, the plaintiff allegedly is still experiencing intense knee pain and is unable to perform her daily activities as she could prior to sustaining her serious Skechers knee injury.

The $40 Million Skechers FTC Settlement Due To Skechers Claims
According to court documents, Skechers indicated to consumers, including the plaintiff, that Shape-Ups were a revolutionary exercise technology, not just a simple sneaker. Court documents also specifically cite Skechers’ own statements in its product literature; these statements imply that, if any injury was thought to be caused by the shoes’ unstable design, it must have actually been caused by the consumer’s misuse of the shoes.

However, the Federal Trade Commission (FTC) found that the “independent” study done by chiropractor Dr. Steven Gautreau did not produce the results claimed in the ads for Shape-ups. Further, it was discovered that Skechers had not only paid Dr. Gautreau to conduct the study but he was also married to a Skechers marketing executive.
