El Paso resident and former newsman John Garmon was hit by a car while crossing a street in downtown El Paso, in what was the second El Paso traffic fatality already this year and the first pedestrian death, according to the El Paso Times. Fatal accidents involving pedestrians have been increasing over recent years, said El Paso personal injury lawyer Michael Gopin.
The El Paso Times story on Jan. 27 describes Garmon as having been run over in a crosswalk by a driver who did not see him and who was unable to slow down in order to avoid hitting the crash victim. The report says that the driver of the car that hit the pedestrian remained at the scene of the accident until police arrived, and that the fatal El Paso collision took place at approximately 8pm on Jan. 26.
While the cause of the Jan. 26 accident is still under investigation, attorney Gopin, of the Law Offices of Michael J. Gopin, P.C., cautions all El Paso pedestrians to be especially careful of drunk drivers in downtown El Paso on weekends. According to the Texas Department of Transportation’s report, “Texas Motor Vehicle Traffic Crash Highlights: Calendar Year 2011,” more Texas DUI accidents took place on Saturdays that year than on any other day of the week. El Paso car accident attorney Gopin also noted that the report shows that Texas pedestrian accident fatalities increased by 17% in 2011 from the year previous and that 34.5% of all motor vehicle crashes in Texas that year involved a driver who was under the influence of alcohol at the time of the accident.
Though the cause of the collision has not yet been established, El Paso personal injury lawyer Michael Gopin said that driver distraction of some kind could also be a factor, such as texting behind the wheel, making a cell phone call while driving, using a GPS unit or an in-dash tablet.
“Distracted drivers who are texting or making cell phone calls while driving can be dangerous to everyone on the road,” Gopin said. “Distracted driving has been linked to all kinds of common accidents, including rear-end collisions and accidents involving pedestrian injuries and fatalities. Drivers who send and read text messages at the wheel may be more distracted than drunk drivers. The El Paso Times article quoted El Paso Mayor John Cook as saying that El Paso has a high rate of pedestrian-motor vehicle collisions. Texas accident lawyer Gopin encourages anyone walking in El Paso to always look for oncoming cars before crossing a street—even on a green light.
