The DePuy ASR hip implant recall was announced in August 2010 after data revealed the hips were failing in 12-13% of patients within just five years. However, according to a report from The New York Times, an internal Johnson & Johnson document introduced during the DePuy ASR hip implant trial estimated that close to 40% of patients will need revision surgery after five years. Other documents introduced at trial indicated that company executives were told by surgeons, who were also paid consultants for the company, that the design of the ASR was flawed. The jury hearing the DePuy ASR hip replacement lawsuit ultimately awarded the Plaintiff $338,000 to cover his medical expenses and $8 million to cover his pain and suffering. The jury chose not to award punitive damages, but one member of the panel told the Los Angeles Times that he and one other juror did favor such an award because Johnson & Johnson knew about high failure rates with the hip implant and it should have recalled the product before 2010.

According to court records, the Los Angeles case was just the first of several DePuy ASR hip lawsuits scheduled for trial this year. Most of the lawsuits filed since the DePuy ASR hip replacement recall are pending in a multidistrict litigation in U.S. District Court, Northern District of Ohio (MDL 2197), where trials are set to begin in the spring. Metal-on-metal hip implants like those named in the DePuy ASR hip implant recall are currently under review at the U.S. Food & Drug Administration (FDA), which warned in January that all-metal hips can shed dangerous amounts of metal ions into patients’ tissue and blood stream, leading to device failure, a condition called metallosis, and other serious complications. The DePuy ASR and other metal-on-metal hip replacements were approved via the FDA’s 510(k) process, which requires no human testing.
