Skechers Injury Lawsuits Allegedly Due To Skechers Shape-Up

According to the complaints for all of these cases, consumers were allegedly wearing their toning shoes while performing their daily activities when the rocker bottom of the shoe rolled inwards or forwards, causing them to sustain severe and painful ankle fractures.

A complaint filed by a woman from Surprise, Arizona (Case No. 3:13-cv-00120) contends that the plaintiff sustained several serious fractures to her right ankle, which required emergency surgery and extensive physical therapy; her Skechers ankle fracture allegedly caused her to lose her job. In (Case No. 3:13-cv-00113), a Dahlonega, Georgia woman is charging that she suffered from two fractures in her right ankle, which required two surgeries and the implantation of screws in her ankle, after regularly wearing Shape-Ups.

In a third Skechers broken ankle lawsuit (Case No. 3:13-cv-00108), an Edmonton, Kentucky woman alleges that wearing Shape-Ups caused her to seriously fracture her right ankle and tear multiple tendons in her left ankle; court documents further state that the ankle fracture required the surgical implantation of a plate and eight screws in her right ankle and that the plaintiff had to wear a boot to try to repair the torn ligaments in her left ankle.

Additionally, while a case filed by a Colorado man (Case No. 3:13-cv-00125) alleges that he tore various tendons in and fractured his left ankle within a month of regularly wearing Shape-Ups, a Houston, Texas woman (Case No. 3:13-cv-00109) sustained three fractures in her leg and ankle allegedly due to unstable Shape-Ups.

Skechers Lawsuits Continue to Rise Even after $40 Million Settlement with FTC

According to court documents, the plaintiffs of these Skechers broken ankle lawsuits purchased Shape-Ups after being swayed by various ads that touted the alleged health benefits of these toning shoes (including that they improved muscle tone and helped wearers get in shape without going to the gym). However, an independent study overseen by the American Council on Exercise (ACE) found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.”

In May 2012, Skechers was legally order to pay the Federal Trade Commission $40 million for such Shape-Ups misleading advertising. As part of this ruling, the court also found that Skechers failed to alert consumers about the possible risks associated with these toning shoes and that Skechers had not perform sufficient safety testing on Shape-Ups.
