A Wallin & Klarich client recently had charges for being under the influence of a controlled substance pursuant to California Health and Safety Code section 11550(a) completely dismissed. The client was represented experienced and drug crime defense attorney, Rastin C. Ashtiani, of Wallin & Klarich.

“The people of California have expressed their desire to see certain drug cases get resolved through drug diversion and alternate sentencing plans that focus on treatment. The voters enacted certain propositions to this effect, and the elected legislature has passed similar laws. However, there is no guarantee that the prosecutor will approve or agree to a resolution besides a criminal conviction,” said Mr. Ashtiani. “If you are charged with a drug or drug related crime, it is imperative that you hire an attorney that will advocate on your behalf.”

According to court record from Ventura County Court the client was at home with a friend one night when he decided to use a controlled substance. After using the controlled substance, the client had an adverse reaction to the drug. As a result of the reaction, the friend of the client called the paramedics to ensure the client was safe and did not suffer any extreme consequences. The paramedics arrived to survey the scene, but later called law enforcement because the client had been using a controlled substance. Law enforcement arrested the client for being under the influence of a controlled substance and the District Attorney later charged the client under California Health and Safety Code section 11550(a). The client faced up to one year in jail, additional fines and a probation period if convicted.

The client sought out the assistance of Mr. Ashtiani to help him get the charges of use of a controlled substance dismissed according to court documents. Mr. Ashtiani first discussed the circumstances of the case with the client. Mr. Ashtiani then contacted the prosecution and convinced them that the case against the client could not be proved beyond a reasonable doubt. Mr. Ashtiani further talked with the prosecution that it would be in the interests of justice to dismiss the charges and not pursue the case. As a result, the prosecution ultimately decided to dismiss the charges against the client for use of a controlled substance. With the help of Mr. Ashtiani, the client was able to avoid a criminal conviction being placed on his record and a jail time sentence.
