The TCPA prohibits companies from using automatic telephone dialing systems to make text message calls to cell phones unless the recipients have provided their prior express consent to receive such messages. According to Gilman Law LLP, short, five-digit codes often indicate that a text message originated from an automatic telephone dialing system. To be actionable under the TCPA, the recipient of the message must not have provided express consent to the sender to receive such messages. According to Gilman Law LLP, recoveries in TCPA lawsuits can be significant. Last August, for example, a franchisee agreed to provide $47 million in services to class members in order to settle a TCPA class action lawsuit filed in U.S. District Court, Southern District of California. The lawsuit had alleged the company violated the TCPA in sending a promotional text message to millions of consumers without prior consent. (Case No. 3:11-MD-02261-JM-JMA)
Court records indicate that a growing number of consumers are choosing to take legal action to put an end to unsolicited text messages that violate the TCPA. Last August, the Huffington Post was named in a class action complaint in the U.S. District Court, Northern District of Illinois, which seeks damages on behalf of all persons who received one or more text messages from the Huffington Post or its agents after requesting that the text messages cease. Last month, Yahoo was named a Defendant in a TCPA lawsuit filed in U.S. District Court, Southern District of California that seeks damages on behalf of consumers who received unwanted text messages from Yahoo without prior or express consent within four years prior to the filing of the complaint.
