Orlando nursing home abuse lawyer, Melvin B. Wright says a new bill has recently been proposed, which will limit lawsuits against nursing home operators. Mr. Wright, founding member of Colling, Gilbert, Wright & Carter, says the bill is yet another example of a health care system run amuck by industry profiteers.
The newly passed bill will limit suits to license holders and their management companies. Mr. Wright says this will permit the private equity firms and parent and subsidiary companies that profit from and control the facilities to avoid accountability for undercapitalizing, underinsuring, undersupplying and understaffing their facilities. He also states they profit almost exclusively from tax dollars in the form of Medicare and Medicaid dollars.
"In our view, the proposed bill immunizes companies who really control the budget and operations of nursing homes by limiting lawsuit defendants in nursing home cases to license holders and their management companies,” said Orlando lawyer, Mr. Wright. “Most nursing homes are actually operated by a maze of legal entities and private equity interests that hold no license but organize under-capitalized shell entities to hold the actual license to the facility.”
He continues saying those profiting from the operation, will not be held accountable for abuse, neglect or negligent harm to residents, no matter how egregious.

Tractor trailers and some professionals and other industries are required to carry minimum levels of liability insurance in order to get licenses and permits to do business. Why not nursing homes who profit from Medicare and Medicaid tax dollars?”
