A Wallin & Klarich client accused of having inappropriate sexual contact with a minor, recently had all charges dismissed under CA Penal Code 288 for lewd or lascivious acts on a child. The client was represented by Wallin & Klarich partner David R. Cohn, who is experienced in handling complex sex crime cases.

“After a year of persecution by the Los Angeles County District Attorney’s office, the criminal justice system worked and my client was vindicated of the sex allegations by a jury acquittal,” said Mr. Cohn.

According to court records from Los Angeles Superior Court - Pomona Courthouse South, the client was accused of kissing a minor child who was the client’s neighbor and would visit the client’s home from time to time. The client was further accused of touching the minor’s private area and forcing the minor child to touch his own private area. As a result of the allegations, the client was charged under California Penal Code section 288 for lewd and lascivious acts with a child. The client faced a sentence of eight years in jail and mandatory registration as a sex offender under California Penal Code section 290 if convicted of the charges.

The client sought out the assistance of Mr. Cohn of Wallin &Klarich to assist him to fight against the severe allegations and the associated consequences. Mr. Cohn discussed the circumstances of the case with the client and quickly began researching the appropriate steps to take. Mr. Cohn provided the District Attorney with information that showed that the client was not guilty of the crimes he was accused of committing according to court record. The case ultimately proceeded to a jury trial that lasted five days. At the trial Mr. Cohn used his experience and legal knowledge to show the jury that the client had not in fact committed the crime of which he was accused and did not deserve to be sentenced to eight years in prison. In the end, the jury found the client not guilty and the client was acquitted of the charges.

After a year of dealing with the allegations and legal battle, the client was overjoyed to hear the jury’s verdict. As a result of Mr. Cohn’s experience in dealing with sex crime cases and his commitment to fighting for a just result in his client’s case, the client no longer faces the threat of jail time or the requirement that he register as a sex offender for the rest of his life. The client is able to move forward with his life without a label as a sex offender.
