Recently, a Wallin & Klarich client was thrilled to regain contact with his children after his former spouse had prevented him from seeing his children. The client was represented by Wallin & Klarich child custody attorney, Sheldon E. Lee, who helped the client establish a custody order that allowed him to consistently see his own children.

“Children should always be a priority in a divorce and custody dispute. As a practicing family law attorney, I make it a priority to have my client’s children returned to their custody, especially if the other parent has unilaterally kept the children away from my client and obstructed my client’s right as a parent without justification,” said Mr. Lee.

According to court record from Riverside County Superior Court, the client came to Wallin & Klarich seeking child custody after the client’s former spouse had taken the children without the client’s consent and prevented the client from seeing the children. Without the assistance of Wallin & Klarich, it would have been difficult for the client to get his children back from his former spouse and he faced the possibility of not being able to see his own children for a considerable amount of time.

After the client contacted Mr. Lee, a Riverside child custody attorney, of Wallin & Klarich, Mr. Lee immediately filed an ex parte motion on behalf of the client. The ex parte motion allowed the client to be heard without the presence of his former spouse, which in turn allowed the court to hear his legal issue quickly. The ex parte motion indicated that the client’s former spouse had taken unilateral parenting actions and refused to let the client see his own children or exercise any custodial rights. Mr. Lee persuaded the court that the client’s former spouse had taken inappropriate actions that were not in the best interest of the children and that the client was entitled to certain custodial rights. Mr. Lee’s motion persuaded the court to order expedited mediation and make a custody order that very same day.

Mr. Lee’s immediate action resulted in the client regaining custodial rights and the ability to see his children on a regular basis. The client no longer lives in fear that he will be unable to maintain contact and communication with his children.
