In spirited pretrial arguments conducted yesterday in a San Diego federal court, attorneys for women allegedly injured by the Mirena IUD argued in support of consolidation of all Mirena cases before a single federal judge. Attorneys representing Bayer Healthcare Pharmaceuticals, the manufacturer of the Mirena IUD, argued against transfer and consolidation of the active litigation.
Appearing on behalf of numerous individual Mirena plaintiffs, Attorney William M. Audet of Audet and Partners, LLP requested that the Mirena litigation be transferred to and consolidated within a San Francisco Federal Court. According to court documents, attorneys for Bayer opposed consolidation by arguing that the number of claims to date simply does not warrant consolidation.
“We know from the influx of Mirena claims being handled by our office that the number of women likely to have been injured as a result of Mirena IUD use is of a size that clearly warrants consolidation,” explains Attorney Audet.
Attorney Audet, who has attended and argued before dozens of federal judicial panels, expressed to yesterday’s Panel that any of the judges currently handling Mirena IUD cases would be excellent appointments for an oversight role in consolidated proceedings. He also noted that it was clear, based on the depth of questioning, that the judges had carefully considered the voluminous documentation submitted by interested parties prior to yesterday’s hearing.
