Godsey Martin, P.C. recently obtained a verdict of $177,606 on behalf of a client who was injured when he fell nearly 12 feet from a balcony and into a ten-foot embankment. The case (number DC-11-15385) was tried in 14th Judicial District Court in Dallas County by the firm’s head of litigation, Brian Mincher, who specializes in large exposure cases, including death, serious injury and surgical error cases.

According to court documents, Luis Hernandez, a construction worker in his mid 30s who’s married with two children, was visiting a relative on Dec. 25, 2010 at his condominium when they decided to take a cigarette break on the balcony. The two were leaning on the balcony rail when it gave way, and they fell eleven-and-half feet into a 10-foot embankment, which led to a creek at the end of a retaining wall. Momentarily unconscious and submerged in the creek, the men were eventually transported to Baylor Hospital by the Dallas Fire Department.

Court documents indicated Hernandez suffered soft tissue injuries, scrapes, bruises, a sprained shoulder and several bulging discs – injuries and damages exceeding the original offer of zero dollars and the $5,000 offered at mediation. The jury ultimately agreed, awarding $177,606 for past medical bills totaling nearly $40,000, past and future physical impairment ($50,000 each) and past and future physical pain and suffering ($20,000 each).

Having worked in-house for more than a decade as an attorney representing big insurance companies, Mincher was not surprised by the $5,000 offer.
