(“Merrill Lynch”). According to SEC filings under Regulation D, which are available at http://www.sec.gov, Merrill Lynch’s alternative investments division raised hundreds of millions from investors in private sales.
According to the prospectus, these Mariner Access Funds gave Merrill Lynch customers access to hedge funds and funds of funds managed by Mariner Investment Group, Inc., the large hedge fund outfit based in Harrison, New York. The Mariner 2x Access Funds gave Merrill Lynch brokerage customers leveraged exposure to the Mariner funds. On March 9, 2009, MarketWatch reported that one Mariner distressed debt fund raised the “gate” on redemptions during the global credit crisis due to investors seeking to exit.
Zamansky is investigating sales of the Mariner Access Fund and the Mariner 2X Access Funds to Merrill Lynch customers and whether they have suffered substantial losses or liquidity problems. “Private investments with leveraged exposure to hedge funds are not suitable for most retail investors,” according to Jake Zamansky. Zamansky believes that investing in funds of funds also creates unique issues for an investor concerning whether there was sufficient disclosure of the material risks associated with the underlying funds.
