Skechers Lawsuits Continue to Rise Even after $40 Million Settlement with FTC

The complaint specifies that the plaintiff purchased her pair of Skechers Shape-Ups in 2010 and wore them during her day-to-day activities. In May 2012, the plaintiff was walking on a flat surface when the rocker bottom of one of her toning shoes caused her foot to roll forward, resulting in the plaintiff falling in excruciating pain. Upon seeking medical attention, physicians informed the plaintiff that had sustained multiple fractures to the bone in her upper arm (her humorous). Due to the nature of these fractures, doctors were unable to place a cast on the plaintiff’s arm to treat her alleged serious Skechers injury. Instead, the plaintiff had to wear a sling for months and, as a result, was unable to work; this created a major financial burden to her family.

Skechers Alleged Negligence
Although Skechers ads alleged that their Shape-Ups offered consumers many health benefits, an independent study overseen by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [http://www.acefitness.org/getfit/studies/toningshoes072010.pdf

Court documents go on to state that “the health risks of Skechers outweigh the absence of any benefit provided to [individuals who wear Shape-Ups].” Specifically, the complaint alleges that Skechers acted negligently by purposely misrepresented the health benefits of these toning shoes [http://www.nbcnews.com/business/skechers-pay-40-million-over-deceptive-ads-775405 and that Skechers was negligent by failing to conduct safety testing on Shape-Ups even after consumers reported Skechers injuries to the Consumer Product Safety Commission (CPSC).
