According to court documents, the accident occurred on Atlantic Boulevard at the intersection with Everington Street in the city of Commerce when BD&J’s client was driving a 1992 Honda CBR600F motorcycle northbound on Atlantic Boulevard in the number two lane towards Everington Street. The at-fault driver was traveling southbound in a 2010 Dodge Journey on Atlantic Boulevard preparing to turn left onto eastbound Everington Street.
The traffic collision report submitted by police indicates that the collision occurred when the SUV failed to yield the right-of-way and made a left turn directly into the motorcycle’s path as it was legally proceeding through the intersection on a green light, causing the collision and BD&J’s client’s injuries.
The injuries suffered by BD&J’s client were substantial. Court documents explain that the motorcycle rider had 2 broken wrists, 2 dislocated elbows and a forearm fracture. Both arms had to be placed in casts due to the fractures. The injured also had a distended stomach and there was evidence of head and brain trauma, police reports indicated that he lost consciousness following the crash and was too injured to give a statement at the time of the accident.
Court documents indicate that this was a Prop 213 case, which means that the injured motorcycle driver was not insured at the time of the accident. Under California’s Prop 213 (California Civil Code §§ 3333.3 and 3333.4.), uninsured motorists involved in accidents are not entitled to recovery of non-economic damages for pain, suffering, inconvenience, physical impairment, disfigurement, and other non-pecuniary damages.
