BridgeFront’s HIPAA online education is now updated with all regulation changes from the Omnibus Rule. Here are the most critical changes that students will now see in our HIPAA education:
- The rule was published in the Federal Register on January 25, 2013. It updates enforcement, security, breach and privacy requirements.
- The effective date is March 23, 2013. Final date when both covered entities and business associates must comply is September 23, 2013.
- Extends all HIPAA Security requirements to business associates.
- Extends penalties for non-compliance to a maximum of $1.5 million per violation.
- Extends breach notification requirements to business associates.
- Requires both covered entities and business associates to meet “Minimum Necessary” on disclosure of PHI.
- Health plans that use or disclose PHI for underwriting must revise its NPP stating that it will not use or disclose genetic information for such purposes under the Genetic Information Nondiscrimination Act (GINA).
“This final omnibus rule marks the most sweeping changes to the HIPAA Privacy and Security Rules since they were first implemented,” said HHS Office for Civil Rights Director Leon Rodriguez.
“These changes not only greatly enhance a patient’s privacy rights and protections, but also strengthen the ability of my office to vigorously enforce the HIPAA privacy and security protections, regardless of whether the information is being held by a health plan, a health care provider, or one of their business associates.”
Federal HIPAA regulations require covered entities and business associates to train staff upon hire and provide refresher training as the regulations shift, and to document this training.
