According to court documents, the plaintiff acquired Magnetix toys, which are toy building sets held together with powerful magnets, in early April 2007. After swallowing some of the Magnetix components, the infant’s parents noticed that their child had begun vomiting and took their child to the emergency room. Upon conducting a comprehensive examination and x-rays, doctors noted that the child had ingested the Magnetix magnetic toy components and that immediate surgery would be required to remove the Magnetix magnets and prevent further damage to the child’s intestines. The Magnetix toy recall complaint goes on to allege that the painful injuries the child sustained due to swallowing Magnetix magnets resulted in damage and injuries. MEGA has moved to dismiss the claim and allegations in this lawsuit.
