Since the FDA issued its warning, thousands of women have filed lawsuits seeking compensation for alleged vaginal mesh complications. According to an Order dated March 9th, four transvaginal mesh lawsuits have been selected for the first bellwether trials in the C.R. Bard litigation underway in the Southern District of West Virginia, with the first to begin in June. According to Alonso Krangle LLP, the results of these trials could provide important clues as to how juries might rule in similar claims.
Verdicts have already been handed down in two vaginal mesh lawsuits involving products manufactured by Ethicon Inc. and C.R. Bard products. In July, a California Superior Court jury hearing a C.R. Bard transvaginal mesh lawsuit awarded $5.5 million to the Plaintiff. (Scott v. Kannappan, S-1500-CV-266034-WDE, Superior Court for Kern County, California) Most recently, the New Jersey Superior Court jury weighing claims in an Ethicon vaginal mesh lawsuit awarded $11.1 million to a woman who suffered injuries due to the Gynecare Prolift vaginal mesh product. (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey (Atlantic City))
The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of transvaginal mesh used in pelvic organ prolapse (POP) and stress urinary incontinence (SUI). In July 2011, the agency revealed that it had received more than 2,800 reports of serious complications associated with the use of transvaginal mesh to treat POP. In September of that year, an FDA advisory panel recommended that pelvic mesh used for transvaginal repair of POP be reclassified as a high-risk medical device. This would make the products ineligible for 510(K) approvals, which do not require that a medical device undergo human testing if the product is “substantially equivalent” to a previously-approved device.
There is still time for alleged victims of transvaginal mesh to seek compensation for their injuries.
