The U.S. Judicial Panel on Multidistrict Litigation (JPML) has issued an order to consolidate all federal defective medical device lawsuits pertaining to the Mirena IUD and uterine perforation, according to court documents (In re: Mirena IUD Products Liability Litigation, MDL-2434 (JPML)).
Mirena is a popular t-shaped intrauterine device that slowly releases a synthetic hormone that prevents ovulation and pregnancy over a five-year period. However, according to the FDA, it may also lead to dangerous side effects and complications. Among the most serious complications is uterine perforation, in which the device migrates through the uterine wall.
Other complications include:
- Severe abdominal pain
- Organ puncture
- Ectopic pregnancy
- Pelvic inflammatory disease (PID)
- Group A streptococcal sepsis
- Breast cancer

Currently, Bayer does not mention the potential dangers of their product in advertisements. Many of the lawsuits filed against the drug maker put forth that the company should warn consumers of the IUD’s dangers and possible adverse effects. At this time, over 40 federal defective product lawsuits are being consolidated for pre-trial proceedings in New York, while dozens of other similar lawsuits are being filed on the state level. Many of the lawsuits claim that Bayer did not properly warn the user about the possibility of device migration and uterine perforation.
