Actos bladder cancer lawsuits continue to move forward in federal and state courts throughout the U.S., Bernstein Liebhard LLP reports. According to, closing statements were delivered yesterday in the nation’s first trial involving an Actos lawsuit, with the Plaintiff’s attorney telling a Los Angeles Superior Court jury that Takeda Pharmaceuticals hid the Actos bladder cancer risk to protect billions of dollars in profits.    “Selling diabetes drugs is big business in America,” the attorney said. “There’s a lot of money to be made.”* (Cooper v. Actos is one of the best-selling type 2 diabetes drugs in the world, and accounted for 27 percent of Takeda’s sales in 2011, according to Bloomberg. In June 2011, the U.S. Food & Drug Administration (FDA) ordered Takeda to add new warnings to the Actos label, after a study found that long-term use of the drug increased the risk for bladder cancer.** Court records indicate that Takeda has since been named in more than 3,000 Actos bladder cancer lawsuits, most of which are pending in a multidistrict litigation underway in U.S. District Court, Western District of Louisiana. The Actos bladder cancer trial underway in Los Angeles was expedited because the Plaintiff, who was diagnosed with bladder cancer in 2011, is “gravely ill,” according to Bloomberg. Evidence introduced at trial included internal Takeda emails that suggested company officials were worried about the impact an Actos bladder cancer warning would have on sales of the drug. “Actos is the most important product for Takeda and therefore we need to manage this issue very carefully and successfully not to cause any damage for this product globally,” a Takeda executive wrote in 2005. Such a development would be a “worst case scenario,” and he urged colleagues to seek a “positive outcome” from “regulatory authorities.”

According to court papers filed ahead of the Actos lawsuit trial, Takeda secretly surveyed a dozen doctors in 2003 to see if they would prescribe a diabetes drug that carried a warning about the potential for bladder cancer. Plaintiff’s attorneys assert the survey found that “a bladder cancer warning would destroy the sales of Takeda’s most important drug, Bloomberg said. ***
