Wright & Schulte LLC, an experienced medical device injury law firm representing numerous women in NuvaRing lawsuits, has filed a new complaint on behalf of Georgia woman who suffered an acute pulmonary embolism, allegedly due to her use of the NuvaRing birth control device. The NuvaRing lawsuit, which was filed in U.S District Court, Southern District of Georgia, names Organon USA, Inc., N.V. Organon, Schering Corp., Merck & Co., Inc., and Merck Sharp & Dohme, Corp. as Defendants. (Case No. 1:13-cv-00052-JRH-WLB)

According to the NuvaRing lawsuit, the Plaintiff began using the NuvaRing vaginal ring in 2009. On April 4, 2011, while still using NuvaRing, she experienced shortness of breath and chest pains, and was ultimately diagnosed with an acute pulmonary embolism. As a result, the Plaintiff was placed on heparin, then Lovenox and was hospitalized for approximately seven days. She remained on blood thinners after her discharge from the hospital, and will require follow-up care.

According to the Complaint, NuvaRing was the first and only once-a-month vaginal birth control ring, and was touted by the Defendants as having the same efficacy as birth control pills or the patch in preventing pregnancy, but with more convenience. The product’s labeling states that the vaginal ring is expected to be associated with similar risks to that of birth control pills. However, the Plaintiff alleges that NuvaRing actually poses higher risks than those associated with oral contraceptives. She further accuses the Defendants of concealing information regarding the increased risk of thrombotic events posed by the contraceptive device.

According to Wright & Schulte LLC, this NuvaRing lawsuit is just one of hundreds of similar claims filed by victims of alleged NuvaRing side effects, including blood clots, pulmonary embolism, deep vein thrombosis, heart attacks and strokes. Court records indicate that more than 1,000 NuvaRing lawsuits are pending in a federal multidistrict litigation before Rodney W. Sippel of the U.S. District Court, Eastern District of Missouri (MDL No. 1964). Additional NuvaRing claims have been filed in a Mass Tort proceeding in the Bergen County Superior Court of New Jersey (Docket No. BER-L-3081-09 MT). The first trial in the federal NuvaRing litigation is scheduled to begin in October 2013, while the New Jersey proceeding’s first trial is expected to begin in June 2013.

According to Wright & Schulte LLC, a growing body of research supports many of the allegations made in NuvaRing lawsuits. For example, a study published by the U.S. Food & Drug Administration (FDA) in 2011 found that NuvaRing raised the risk of blood clots, including deep vein thrombosis and pulmonary embolism, by 56% when compared to older birth control pills. In the summer of 2012, two additional studies published in The New England Journal of Medicine and the British Medical Journal indicated that users of NuvaRing faced a higher risk of suffering dangerous blood clots, as well as heart attacks and strokes.
