According to court documents, Judge Kirwan of the Superior Court of Santa Clara, California, signed a Final Judgment on April 18, 2013 in Case No. 1 11 CV 211994, ordering GPC to pay the inventor, Dr. Uri Cohen, more than $308,000 in attorney’s fees, costs, and interest.
According to court documents, back in 2010, Dr. Uri Cohen assigned his seed layers patent portfolio to Seed Layer Technology LLC (SLT), a company solely managed and controlled by General Patent Corporation (GPC). General Patent Corporation (GPC) is solely controlled by Mr. Alex Poltorak, the CEO and majority stockholder of GPC. Under the contract between the inventor and GPC/SLT, GPC/SLT was required to assert the Seed Layers patents against infringers or enter into substantive licensing negotiations within a set deadline, or else return the patent portfolio back to the inventor. In 2011, after GPC/SLT failed to perform under the contract, Dr. Cohen demanded his patent portfolio back, but GPC/SLT refused to comply. The inventor then sued GPC/SLT in the Superior Court of Santa Clara, California, Case No. 111CV211994, for the return of his patent portfolio and damages. In response to GPC/SLT motion, Judge Kirwan ordered a Stay of Final Judgment, pursuant to Arbitration in New York. On November 14, 2012, the New York Arbitrator, Mr. Stephen Gilbert (Case AAA No. 13 117-Y-00488-12), awarded Dr. Cohen his Seed Layers patent portfolio, attorney’s fees and costs, and breach of contract damages.
According to court documents, as GPC and Mr. Poltorak did not fully comply the Arbitration Award, Judge Kirwan confirmed on January 28, 2013 the Arbitration Final Award in favor of the inventor. Nonetheless, as GPC and Mr. Poltorak did not comply with the orders to pay the inventor, Judge Kirwan signed on April 18, 2013 a Final Judgment ordering GPC to pay Dr. Uri Cohen attorney’s fees, costs, and interest, totaling over $308,000.
