A Wallin & Klarich client recently was able to reach an amicable divorce settlement agreement with her former spouse concerning contentious issues like child custody, visitation, child support, and property division. The client was represented by experienced family law attorney, Matthew E. Forsse of Wallin & Klarich, who guided her through the settlement negotiations while keeping her best interests in mind.
“Whenever I believe that the parties in a divorce proceeding are amicable, it is prudent to discuss the possibility of reaching an agreement that works for the parties and avoids the unnecessary stress and time of court hearings. Not only is it usually more cost-effective for the client, but reaching a settlement agreement on any or all of the issues in a divorce puts the power in the client’s hands to receive orders that they are satisfied with. In every single case we handle at Wallin & Klarich, we encourage and promote the idea of reaching an agreement with the other party if possible,” said Mr. Forsse.
According to court record from Stanley Mosk Courthouse – Los Angeles, the client was married for eight years and two months and had two children with her former spouse during the marriage. The client sought out the assistance of family law attorney Matthew E. Forsse to resolve the child custody, visitation and support issues in the divorce. In addition, the client and her former spouse had several complex property issues that had come up in the divorce proceedings, including the division of the family residence and other investment properties.
Mr. Forsse met with the client and became familiar with what issues in the divorce were most important to her. Mr. Forsse then entered into negotiations with the client’s former spouse and the opposing counsel according to court documents. Mr. Forsse was firm with the opposing counsel relating to the client’s top priorities, but flexible in order to reach an agreement.
After multiple discussions concerning proposed settlement agreements on all of the issues, the parties were able to reach an agreement that was fair to both parties according to court record. The settlement agreement provided each party with joint legal custody of the children, but primary physical custody was awarded to the client. In addition, the parties agreed that the client’s former spouse would pay $1000 a month in child support. Lastly, Mr. Forsse and the client were able to convince the opposing party to agree that the family residence would continue to be held by the parties as co-owners and other investment properties would be held for the benefit of the children in a trust. As a result of the agreement, the client was able to gain a peaceful divorce where all of her goals were met, and avoid the stress of a lengthy court trial.
