The personal injury lawsuit was settled on April 18, 2013 by firm Partners David L. Scher and Stephen J. Murphy, shortly before the scheduled trial that would have proceeded in New York Supreme Court, Kings County under Index Number 5230/2010.
The incident occurred on June 6, 2010, while Plaintiff was washing the 2nd floor exterior windows of an office building located at 30 West 26th Street in Manhattan. Plaintiff fell 15-20 feet to the ground when the bolt securing him to the building suddenly pulled out of the exterior wall. These facts were established by Plaintiff's December 22, 2010 deposition testimony, the sworn Affidavit of Plaintiff's helper, as well as and the incident report prepared by the Defendant building's property manager. In a summary judgment motion filed with the Court that sought to dismiss Plaintiff's case, Defendants argued that Plaintiff had been instructed by his boss prior to the accident to avoid using the bolts.
Plaintiff, who was a 60 year old Brooklyn resident, suffered multiple fractures to his left arm, pelvis and hip in the fall. Plaintiff underwent two open reduction / internal fixation surgeries in the days following the accident at Bellevue Hospital, one to his left arm and one to his left hip. Plaintiff also underwent several irrigation and debridement procedures to clean the wound to his left arm. These injuries were revealed in the Bellevue Hospital records. Defendants, through the reports of their expert medical witnesses, contended that Plaintiff had made an excellent recovery before the time of settlement.
