The attorneys at Wright & Schulte, LLC have filed an Imprelis lawsuit on behalf of an Indiana Country Club and Golf Course located in Bloomington. This case (case no. N13C-04-044 EMD) was filed on April 4, 2013 and names E.I. DuPont De Nemours and Co. as the defendant. As with previously filed Wright & Schulte Imprelis lawsuits, this case will be litigated in the Superior Court of Delaware, New Castle County.

This Imprelis tree damage lawsuit contends that many of the trees and much of the landscaping on the Country Club’s golf course was irreparably ruined after a few applications of Imprelis. The resulting Imprelis tree damage, according to the complaint, allegedly resulted in the Country Club losing a significant amount of business and profits. Additionally, this Imprelis Lawsuit contends that DuPont failed to warn consumers about the risks of severe Imprelis tree damage, even going as far to blame consumers for Imprelis tree damage due to not properly applying the herbicide, after many consumer nationwide had reported problems with Imprelis.

Despite the fact that some Imprelis tree damage lawsuit have been consolidated into a class action lawsuit, that is being litigated in a federal court in Philadelphia, (Case No. 11-md-2284), many plaintiffs have choosen to opt out of the Imprelis class action lawsuit, especially in light of the reportedly paltry settlement offers DuPont has made in these cases. According to court documents, employees of the plaintiff had applied Imprelis to the golf course grounds in April 2011 in an attempt to increase the aesthetic appeal of the landscaping to patrons. Unfortunately, however, the use of Imprelis allegedly had the opposite effect and resulted in extensive damage to the golf course’s trees, shrubbery, flowers and other plant life. Some of the signs of Imprelis tree damage that were apparent to the plaintiffs included browning, curling, twisting, stunted leaf growth and stem die-back. As a direct result of this Imprelis tree damage, the complaint alleges that the Country Club lost patrons and that the business’ profits took a nosedive.

EPA Orders DuPont to Stop Selling Imprelis
In June 2011, the EPA initiated its own investigation into the alleged problems with Imprelis after nationwide consumer of Imprelis tree damage began accumulating. Within a few months, the EPA had uncovered sufficient evidence that Imprelis was responsible for seriously damaging or killing thousands of trees and, as a result, ordered DuPont to immediately stop selling and distributing Imprelis herbicide. At that time, the EPA has received more than 7,000 reports of Imprelis tree damage from consumers nationwide.
