This is an interesting case and a good theory has been offered by the police as it does seem that, in my professional opinion that this unnamed man could have been a burglar who was very unlucky.

According to The Telegraph article dated 2nd May: Suspected 'burglar' found stuck in chimney of Derby grade II listed building, police are investigating the possibility that a body found in a grade II listed building, used by solicitors firm, was attempting to break in when he got stuck in the chimney. The alleged burglar is thought to have been attempting to break in to the solicitors as a number of other firms had been targeted by criminals in recent weeks. The remains of the unknown man, discovered by police, were wedged in the chimney after employees reported a sickening smell wafting through the Victorian-era premises

The Telegraph report goes on to say that they understand that due to the historic listing of the building police were forced to call specialists to remove part of the chimney before the significantly decomposed body was removed late on Wednesday. A post mortem examination is due to take place later, where it is hoped that the identity of the would be burglar will be discovered.
