The product liability attorneys at Wright & Schulte, LLC have filed an Imprelis lawsuit on behalf of 22 lawn care companies and property owners in Ohio, New Jersey, Wisconsin, Iowa, and Minnesota. This case (case no. N13C-04-045 EMD) was filed on April 4, 2013 and names E.I. DuPont De Nemours and Co. as the defendant. As with previously filed Wright & Schulte Imprelis lawsuits, this case will be litigated in the Superior Court of Delaware, New Castle County.

This Imprelis tree damage lawsuit alleges that Imprelis use was responsible for permanently damaging, if not killing, many of the plaintiffs’ trees, shrubs and other vegetation and that DuPont falsely advertised the safety and effectiveness of Imprelis to consumers. Additionally, this case contends that some of the plaintiffs’ lawn care companies suffered serious damage to their businesses’ reputation and profits after use of Imprelis on their clients’ properties resulted in severe tree damage.

Although some plaintiffs with Imprelis awsuits have united their complaints into class action lawsuits that are being litigated in a federal court in Philadelphia, many others are opting out of joining these Imprelis class action lawsuits, especially in light of the reportedly paltry settlement offers DuPont has made in these cases. In fact, Richard Schulte, a partner with Wright & Schulte LLC, has stated that the Imprelis settlement offers DuPont has made to date are insufficient to cover the extensive costs caused by Imprelis tree damage. “None of our clients are participating in the settlements because the offers are inadequate,” stated Mr. Schulte.

According to court documents, Imprelis was applied by the employees of the landscaping companies in this lawsuit throughout the spring of 2011. The individual property owners in this lawsuit also hired various lawn care companies (different from the plaintiffs in this case) in their respective states throughout the spring of 2011. While the lawn care companies had reportedly applied Imprelis as specified by DuPont, within months of the Imprelis application, trees and other plant life on the plaintiffs’ property (or on the properties of the plaintiffs’ clients) had all reportedly sustained severe damage. For some plaintiffs, a single application of Imprelis was allegedly sufficient to cause such devastation. While the individual property owners in this case allegedly sustained severe Imprelis tree damage and death, the lawn care companies suffered severe damage to their businesses’ reputations and profits allegedly due to the Imprelis damage.

EPA Orders DuPont to Stop Selling Imprelis
As nationwide consumer reports of Imprelis tree damage began accumulating after the herbicide’s introduction in October 2010, by June 2011, the EPA initiated its own investigation into the alleged problems with Imprelis. Within a few months, the EPA had uncovered sufficient evidence that Imprelis was responsible for seriously damaging or killing thousands of trees and, as a result, ordered DuPont to immediately stop selling and distributing Imprelis herbicide. At that time, the EPA has received more than 7,000 reports of Imprelis tree damage from consumers nationwide.
