Any time one driver is clearly at fault for an accident, they can be held liable for all damages and medical costs.

Footage from a traffic camera released last week shows a harrowing car crash – and one pedestrian's dash to safety as a vehicle comes within inches of killing him. Attorney Michael Steinger, who focuses his practice on helping car accident victims, says that the video creates a very clear picture of what happened and that there will almost certainly be a lawsuit.
The crash occurred early in the morning of April 15. The footage, shot by a law enforcement camera that monitors the intersection, shows a pedestrian crossing legally. A speeding car then runs the red light and strikes another vehicle, hurtling toward the pedestrian in a cloud of smoke according to NBC News 6 South Florida (5.3.13).
The pedestrian ran, getting out of the way just in time to avoid being hit. The drivers of both vehicles were hospitalized, according to the police report.
“Any time one driver is clearly at fault for an accident, they can be held liable for all damages and medical costs,” said Steinger. “It's hard to be any more clear than this video.”
Since the video has been released to the public, Steinger says it can likely be used as evidence in a civil lawsuit.
“There is no doubt that one driver ran the red light and caused the accident,” Steinger said. “I would expect the victim to sue and win.”
Steinger says that such lawsuits are a crucial part of justice for victims whose injuries and damages often exceed what's paid by insurance.
