LibertyBell Civil Lawyers Cheer the Pending California Employment Law

LibertyBell Civil Lawyers are cheering on the passing on of a new California employment law geared towards anti-discrimination by employers and businesses. The new employment law, SB 404, amends the California Fair Employment and Housing Act by adding "familial status" as an additional protective status.

LibertyBell civil lawyers encourage the passing of the new California employment law, SB 404, now pending in the Senate Appropriations Committee. The new law, introduced by Senator Jackson, amends the California Fair Employment and Housing Act. Law SB 404 adds “familial status” as an additional protective status.

LibertyBell civil lawyers express that non-employment related questions on familial status of employees or applicants used in interviews or on applications may lead to discrimination. Though some businesses or employers may collect such information for statistical analysis, unfortunately it is sometimes misused.
Unacceptable employment inquiries about “familial status” are:

  •     Marital status
  •     Spouses’ occupation (if not employed by the same business), income or more
  •     Ages and number of children or dependents
  •     Pregnancy, child birth, or birth control
  •     Addresses or names of relatives, spouses, or children

However, there are federal laws already prohibiting this type of discrimination for employment or during. Furthermore, there are other federal and California anti-discrimination laws, family leave laws, and other legal proceedings that combat discrimination based on familial or marital responsibilities or status shielding employees.

LibertyBell civil lawyers speculate, from experience, that businesses and employers are often unaware they are conducting illegal activities, whether indirectly or directly. When engaging in such activities employers are at risk of high litigation costs and the time and efforts of having to deal with mediation, arbitration, or worst yet, a civil lawsuit. When employers do not meet the needs of their employees they are also at risk of high turnover rates.

“Our civil lawyers have worked with a broad range of businesses; and we are keenly aware of how much employers sometimes lack in knowledge about California and federal laws regarding labor and employment. Many good intentioned employers just don’t realize the legal dangers they are exposed to because they’re only focused on growing their business and revenue,” says Irena Shut, a top civil lawyer from LibertyBell Law Group.
