The new employment law, SB 404, amends the California Fair Employment and Housing Act by adding "familial status" as an additional protective status.

The new law, introduced by Senator Jackson, amends the California Fair Employment and Housing Act. Law SB 404 adds “familial status” as an additional protective status.

LibertyBell civil lawyers express that non-employment related questions on familial status of employees or applicants used in interviews or on applications may lead to discrimination. Though some businesses or employers may collect such information for statistical analysis, unfortunately it is sometimes misused.
Unacceptable employment inquiries about “familial status” are:

  •     Marital status
  •     Spouses’ occupation (if not employed by the same business), income or more
  •     Ages and number of children or dependents
  •     Pregnancy, child birth, or birth control
  •     Addresses or names of relatives, spouses, or children

However, there are federal laws already prohibiting this type of discrimination for employment or during. Furthermore, there are other federal and California anti-discrimination laws, family leave laws, and other legal proceedings that combat discrimination based on familial or marital responsibilities or status shielding employees.
