According to the Dupont C8 lawsuit (Case No. 2:13-cv-00479-GLF-TPK), C8, also known as perfluorooctoanoic acid (PFOA), was allegedly used for decades at DuPont’s Washington Works plant. The complaint alleges that as early as the 1980s, DuPont had information in its possession that indicated exposure to C8-tainted drinking water could lead to various adverse health consequences in exposed workers. The Plaintiff further claims DuPont has known for several decades that discharge of C8 into the Ohio River from its Washington Works Plant contributed to the levels of C8 present in human water supplies, and that this discharge could be reduced substantially by use of a carbon absorption treatment system at the facility.

DuPont C8 Class Action Lawsuit Settlement
In 2005, DuPont reached a settlement in a C8 class action lawsuit which, among other things, required it to establish a scientific panel to explore the health consequences of C8 exposure. The 2005 settlement also stipulated that class members who consumed C8-tainted drinking water from one of six Ohio and West Virginia water districts for at least 1 year prior to December 3, 2004 would have the right to sue for personal injuries if they developed a disorder that the Panel ultimately deemed a “probable link” disease. (Leach v. E.I. Du Pont De Nemours & Co., No. 01-C-608 (W. Va. Cir. Ct.)

In October 2012, the C8 Science Panel reported that it had established a probable link between exposure to C8 contaminated drinking water and a number of illnesses, including kidney cancer. The water districts affected by the DuPont class action lawsuit settlement include:

  •     Little Hocking, Ohio
  •     City of Belpre, Ohio
  •     Tuppers Plains, Ohio
  •     Village of Pomeroy, Ohio
  •     Lubeck Public Service District, West Virginia
  •     Mason County Public Service District, West Virginia

According to Wright & Schulte LLC, residents, former residents, their survivors, or anyone else who consumed water in one of these six districts during the time period specified by the DuPont C8 class action lawsuit settlement is eligible to file a personal injury claim against DuPont, so long as they developed a disorder cited in the C8 Science Panel report.
