Officials at the U.S. District Court for the Southern District of West Virginia have recently held a vaginal mesh lawsuit status conference to go over the various issues that have arisen from the bellwether Ethicon mesh lawsuit (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey). This conference was held both in response to the growing number of transvaginal mesh lawsuits or bladder mesh lawsuits that have been filed against Ethicon and the recent settlement of the first bellwether Ethicon mesh lawsuit.
Among the agenda items discussed during the May 23, 2013 Case Management Conference for Ethicon vaginal mesh litigation (MDL 2327) included the coordination of the discovery process, scheduling of the hearings for the subsequent selected bellwether cases, deposition scheduling issues and issues stemming from third-party protective orders. How the court ultimately decides to iron out these and other issues that were generated by the first Ethicon vaginal mesh lawsuit will significantly affect upcoming Ethicon vaginal mesh litigation. The first Ethicon Vaginal Mesh Lawsuit related to Gynecare mesh slings was litigated in New Jersey’s Atlantic County Superior Court and concluded this past March with the plaintiff being awarded more than $11 million for her injuries and losses. According to the New Jersey Courts’ website, 2,831 Gynecare bladder mesh lawsuits have been filed against Ethicon as of May 28, 2013. While the first bellwether Ethicon case has recently been settled, the bellwether trials for C.R. Bard mesh litigation are scheduled to start on September 23, 2013.
