Columbus, OH (PRWEB) May 29, 2013

Officials at the U.S. District Court for the Southern District of West Virginia have recently held a vaginal mesh lawsuit status conference to go over the various issues that have arisen from the bellwether Ethicon mesh lawsuit (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey). This conference was held both in response to the growing number of transvaginal mesh lawsuits or bladder mesh lawsuits that have been filed against Ethicon and the recent settlement of the first bellwether Ethicon mesh lawsuit.

Among the agenda items discussed during the May 23, 2013 Case Management Conference for Ethicon vaginal mesh litigation (MDL 2327) included the coordination of the discovery process, scheduling of the hearings for the subsequent selected bellwether cases, deposition scheduling issues and issues stemming from third-party protective orders. How the court ultimately decides to iron out these and other issues that were generated by the first Ethicon vaginal mesh lawsuit will significantly affect upcoming Ethicon vaginal mesh litigation. While the first bellwether Ethicon case has recently been settled, the bellwether trials for C.R. Bard mesh litigation are scheduled to start on September 23, 2013. As of May 28, 2013, 519 transvaginal mesh lawsuits had been against C.R. Bard in New Jersey Courts. [judiciary.state.nj.us/mass-tort/pelvicmesh/bard/bard-case.pdf May 2013]

Vaginal Mesh Lawsuits
Claims that Gynecare mesh slings and other Ethicon bladder mesh implants have caused thousands of women to suffer from severe complications and injuries have been at the heart of the numerous lawsuits filed against Ethicon. Some of the serious problems reportedly associated with Ethicon’s Gynecare slings allegedly include urinary pain, pain during intercourse, vaginal scaring, mesh erosion through the vaginal lining, an increased risk of infection, puncturing of the blood vessels/bowels/bladder and recurrence of stress urinary incontinence (SUI). At that time, the FDA announced that about 10 percent of women with a mesh sling has developed or would develop serious complications and that many women with serious transvaginal mesh complications required or would require invasive revision surgery and possibly the removal of the mesh sling within one year of implantation.
