On May 8, 2013 the San Diego employment lawyers at Webb & Bordson and Blumenthal, Nordrehaug & Bhowmik filed a class action complaint against Lyon Management Group, Inc. for alleged wage and hour violations. Sullivan v. Lyon Management Group, Case No. 30-2013-00649432-CU-BT-CXC, is currently pending in the Orange County Superior Court for the State of California.
According to the class action complaint filed against Lyon Management Group, the property management company paid their non-exempt employees non-discretionary commission and bonus wages based on their performance in the communities these employees worked. According to the lawsuit Lyon Management Group, “failed and still fails to include the commission and bonus compensation as part of the employees’ ‘regular rate of pay’ for purposes of calculating overtime pay.” The complaint also alleges that the failure to include the commission and bonus compensation in the regular rate of pay, "has resulted in a systematic underpayment of overtime compensation" to Lyon Management Group's non-exempt employees paid on an hourly basis.
Moreover, the class action complaint filed against Lyon Management Group alleges that as a result of Lyon’s failure to correctly calculate and pay these employees the correct overtime rate, “the wage statements issued to Plaintiff and other California Class Members violate California law, and in particular, Labor Code Section 226(a).”
