Mirena lawsuit claims filed in the state of New Jersey have been consolidated in a Multicounty Litigation and transferred to Bergen County Superior Court, Bernstein Liebhard LLP reports. According to a Notice to the Bar dated May 24, 2013, the New Jersey Supreme Court has assigned the Mirena side effect claims to Superior Court Judge Brian R. Martinotti. Court records indicate that Judge Martinotti has already issued the litigation’s first Case Management Order, which schedules an initial Conference for June 17, 2013. Mirena Side Effect Lawsuits
Court documents indicate that at least 60 Mirena side effects claims had been filed in New Jersey courts as of March 2013. All of the Mirena IUD lawsuits allege the device migrated away from its original position in the uterus, leading to uterine perforations and other serious injuries. Plaintiffs further allege Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risk of device migration and related Mirena complications such as uterine perforations.
Dozens of Mirena lawsuits have also been filed in federal courts throughout the U.S. On April 8th, the U.S. Judicial Panel on Multidistrict (JPML) transferred all federally-filed claims to the U.S. District Court, Southern District of New York for pretrial proceedings. That litigation’s first Status Conference was held on May 17th. On May 22nd, the Judge presiding over the federal Mirena IUD lawsuits issued an Order appointing Plaintiff’s attorneys to serve in leadership positions for the proceeding. The Order also directed those attorneys to submit a proposal naming additional lawyers to serve on the Plaintiffs’ Steering Committee to the Court by June 17th.
The Mirena IUD has been on the U.S. market since 2000, and is approved as both a contraceptive and a treatment for heavy menstrual bleeding in women who wish to use an IUD for birth control. In December 2009, the U.S. Food & Drug Administration (FDA) issued a warning letter to Bayer after finding that one of its promotional campaigns for the IUD exaggerated the efficacy of the device and minimized potential Mirena side effects. Among other things, the FDA disputed claims touting Mirena’s purported ability to improve a woman’s sex life and help her “look and feel great.*
