Tough regulations from the Health and Safety Executive (HSE) allow prosecution of industrial property owners if they fail to prevent untrained workers being exposed to asbestos fibres. We at RJS Waste Management’ recommend doing an asbestos survey in such situations: They did not commission an asbestos survey, as is recommended by all new property owners.
Recetly it has seemed like there have been monthly new legal proceedings against property owners, for breaches of the Control of Asbestos Regulations (2012). The Control of Asbestos Regulations were written into UK law in 2006 and updated in 2012 but companies are still failing to comply with them.
Asbestos-related diseases are known to be responsible for around 4,000 deaths a year. Working on or near damaged asbestos-containing materials or breathing in high levels of asbestos fibres, which may be many hundreds of times that of environmental levels, could increase your chances of getting an asbestos-related disease.

Owners and managers of non-domestic properties have a duty to manage asbestos containing materials under Regulation 4 of CAR(2012) and the best, and only recognised method to achieve this is to first identify the extent and condition of those materials through an asbestos survey. This includes both asbestos, as well as other hazardous waste, where a chemical waste disposal company is required.
Purely having a survey commissioned is not enough and it has to form part of a complete management plan and be made available to anyone conducting work that is likely to disturb those materials identified.
