Los Angeles criminal defense attorney Robert Helfend has successfully secured a dismissal for a client who had been arrested and charged with Possession for Sale of a Controlled Substance. Mr. Helfend sought the dismissal of charges against his client from the Los Angeles Superior Court, case number GA085681, after California Department of Motor Vehicles (DMV) records showed that the arresting agency made contradictory statements regarding the circumstances of the client's arrest.
"My client was arrested after he had decided not to complete a previously arranged drug transaction," says Mr. Helfend. "The arresting agency searched my client's vehicle and found one pound of methamphetamine."
The Court and the District Attorney concluded that the search and arrest were illegal after Mr. Helfend elicited contradictory statements from the arresting officer concerning his client's detention. Further, Mr. Helfend explains, the arresting agency's records of the incident did not support the officer's version of the events that led up to his client's arrest.
"Once we asked for transcripts of the Deputy's radio transmissions and records of the traffic stop made on the Deputy's mobile computer, it became clear that the agency's own records and those of the DMV did not support the Deputy's version of the events of that day. We filed a motion to suppress the evidence found during the search of my client's vehicle, and were able to get the charges against my client dismissed.
Mr. Helfend says that making sure that all of the assertions presented by an arresting agency align with the records of an event is an essential element of criminal defense. "Having records that didn't support the Deputy's versions of the event enabled us to persuade the District Attorney and the Court that my client's arrest was illegal and that the search of his vehicle was tainted as a result. Without the evidence secured during the search, the DA was unable to proceed to trial in this case."
