New York is number 10 on a Top 10 list for dog bite claims nationwide released by State Farm Insurance. According to the May 15 report, in 2012 State Farm had 3,670 dog bite claims and paid more than $108 million as a result of dog attacks. This is a slight decrease compared to the claims in 2011 (3,750 claims) and the $109 million paid as a result of dog bite claims in 2011, the report states. While California, Illinois and Texas led these rankings, State Farm recorded 116 claims in New York and paid $6.4 million for dog bite claims.

According to the U.S. Centers for Disease Control and Prevention (CDC), 800,000 Americans seek medial attention for dog bites, half of them children. Of those who are injured, 386,000 require emergency treatment and 16 are fatally injured, the CDC states. Children between 5 and 9 years of age suffer the highest rate of dog bite injuries and almost two thirds of injuries among children 4 years or younger are to the head or neck region, the federal agency reports.

Dog attacks have the potential to cause significant injuries or even death, said New York personal injury lawyer Kenneth A. Wilhelm. "We have represented dog bite victims of all ages and we often see that these victims suffer serious injuries that can leave them scarred and disfigured for the rest of their lives. Dog bite incidents can also have a significant impact on the victim's psychological and emotional well being. Our firm recovered $750,00 for a girl who was bitten by a dog, which was the largest amount recovered for a dog bite in New York in 2010."

Injured dog bite victims can seek compensation to cover their losses, Wilhelm said. "Dog bite victims struggle to pay cosmetic surgery expenses because these are usually not covered under health insurance. There are also other medical expenses and wages lost during the recovery period that increase a victim's financial burden. Innocent victims should not have to pay for the actions of negligent dog owners."
