Columbus, OH (PRWEB) June 03, 2013
Wright & Schulte LLC, an experienced law firm investigating Da Vinci robotic surgery lawsuits, reports that claims alleging serious Da Vinci robotic Surgery complications continue to move forward in courts throughout the country, despite the recent jury verdict in the nation’s first Da Vinci robot lawsuit trial in Washington State. (Estate of Fred E. Taylor v. Intuitive Surgical Inc., 09-2-03136-5, Superior Court, State of Washington, Kitsap County) On April 19th, Intuitive Surgical disclosed in a filing with the U.S. Securities and Exchange Commission (SEC) that it had been named in at least 26 Da Vinci robot lawsuits, and had entered into tolling agreements in some of those cases. According to Wright & Schulte, tolling agreements suspend statutes of limitations, and are usually entered into to give the parties an opportunity to resolve claims out-of-court.

Earlier this month, a Washington State jury returned a verdict favoring Intuitive Surgical in a Da Vinci lawsuit filed by the family of a man who had died several years after suffering serious complications during a robot-assisted prostate removal surgery. According to court documents, the family’s lawsuit had alleged that Intuitive was negligent in training the doctor who performed the surgery. They further alleged that Intuitive watered-down its training program in order to encourage more doctors to use the da Vinci robot. (Estate of Fred E. Taylor v. Intuitive Surgical Inc., 09-2-03136-5, Superior Court, State of Washington, Kitsap County)
According to Wright & Schulte, this particular da Vinci robot lawsuit presented many unique facts that likely drove the jury’s decision, and should not necessarily be viewed as predictive regarding outcomes in other claims that allege da Vinci robotic surgery complications. In fact, according to a Reuters report from May 28th, the attorney representing the Washington plaintiffs predicted thousands of additional da Vinci surgery robot filings, calling his clients’ case only the “tip of the iceberg.”
