California Superior Court Judge J. Stephen Czuleger has upheld the $8.3 million verdict in the case of Kransky v. DePuy (BC456086, California Superior Court, Los Angeles County), providing hope for others on their pending DePuy Orthopedics cases. The denial of Johnson & Johnson’s motion for a new trial is a reassuring win for the thousands of other individuals who have currently pending DePuy lawsuit cases of their own involving the DePuy ASR hip system, notes Darren Miller of the law firm D. DePuy initiated a voluntary recall of the ASR hip system in June 2010, after receiving reports that patients were requiring a revision surgery or were experiencing metal toxicity as a result of the device." According to Miller, DePuy ASR and other metal-on-metal hip implants were approved by the FDA through the 510(k) process, which does not require any testing of safety or efficacy before the approval if the manufacturer is able to show that the medical device is substantially similar to another device already on the market (see: accessdata.fda.gov/cdrh_docs/pdf8/K080991.pdf). The FDA, as of January 2013, requires manufacturers of metal-on-metal hip replacement systems to submit a more stringent pre-market approval application requiring a showing of safety and efficacy before approval of the device (see: fda.gov/MedicalDevices/Safety/AlertsandNotices/ucm335775.htm).
