Serious complications for transvaginal repair … are not rare.

The law firm D. Miller & Associates, PLLC reports that progress is being made in the many vaginal mesh lawsuits against manufacturers of vaginal mesh implants across the United States, providing hope for those alleging personal injury caused by such devices. "A pretrial order shows agreement has been reached in regards to the application of the statute of limitations and delayed filing of transvaginal mesh lawsuit claims in the four multidistrict litigation cases pending in the Southern District of West Virginia*, notes vaginal mesh lawyer Darren Miller. Miller says that the safety of pelvic mesh devices, which are used to treat pelvic organ prolapse and stress urinary incontinence, has been a concern for the U.S. Food & Drug Administration (FDA) since a warning was issued by the agency in October 2008 (see: fda.gov/MedicalDevices/Safety/AlertsandNotices/PublicHealthNotifications/ucm061976.htm). He points out that, in a July 2011 safety communication, the FDA stated that “serious complications for transvaginal repair … are not rare.” The FDA also stated in that communication that vaginal mesh might in fact put patients at a greater risk of serious complications, he adds (see: fda.gov/MedicalDevices/Safety/AlertsandNotices/ucm262435.htm). “Thousands of cases alleging serious complications with this device have been, and continue to be, reported to the FDA, “ says Miller.

Women have filed suit against the manufacturers of these mesh implants, alleging the manufacturers were negligent in failing to warn consumers of the serious effects that may result from use of the device, the vaginal mesh attorney adds. “These women contend they were were not made aware of the very serious complications which might arise from the vaginal mesh implants, or the risks they may have been exposing themselves to because of the mesh implants. For the harm and pain they possibly suffered as a result, they should be entitled to compensation—and we are here to help them get that compensation.”
