All of the Dupont C8 lawsuits pending in the litigation allege personal injury or death due to exposure to C8 tainted drinking water associated with DuPont’s Washington Works plant in Parkersburg, West Virginia. According to the C8 lawsuits filed in the Southern District of Ohio, C8 is a chemical in Teflon that was used for decades at the DuPont Washington Works plant. Plaintiffs allege DuPont had information in its possession as early as the 1980s that indicated exposure to C8-tainted drinking water could lead to various adverse health consequences in exposed workers. In 2005, the company reached a C8 class action lawsuit settlement affecting some 70,000 West Virginia and Ohio residents who had been exposed to C8 tainted drinking water associated with pollution from the DuPont facility. As part of that agreement, DuPont established the C8 Science Panel to explore the possible health effects of C8 exposure. The C8 class action lawsuit settlement also stipulated that individuals who developed any illnesses ultimately linked to C8 exposure by the Science Panel would maintain their right to file an individual personal injury lawsuit against DuPont. Those six water districts include:

  •     Little Hocking, Ohio
  •     City of Belpre, Ohio
  •     Tuppers Plains, Ohio
  •     Village of Pomeroy, Ohio
  •     Lubeck Public Service District, West Virginia
  •     Mason County Public Service District, West Virginia

In October 2012, the C8 Science Panel announced it had established probable links between C8 exposure and several illnesses and disorders, including thyroid, kidney and testicular cancer, ulcerative colitis/inflammatory bowel disease, pregnancy-induced hypertension (pre-ecamplsia), and high cholesterol. To be eligible to file a C8 lawsuit in the federal litigation, potential plaintiffs must have lived or worked in one of the six West Virginia or Ohio water districts for at least a year prior to December 3, 2004, and develop one of the illnesses designated by the C8 Science Panel as a probable linked disease. Family members of individuals who died as a result of one of these diseases may also file a wrongful death lawsuit on their behalf, so long as their loved one lived or worked in one of the water districts during the time period stipulated by the DuPont C8 class action lawsuit.
