The product liability attorneys at Wright & Schulte have filed a Skechers lawsuit on behalf of a Georgia woman who developed bulging discs in her back allegedly caused by the defective design of Shape-Ups toning shoes. This case (case no. 3:13-cv-00339-TBR) was filed in April of 2013 and is part of MDL 2308. As with other Skechers lawsuits recently filed by Wright & Schulte, this case will be heard in the U.S. District Court of the Western District of Kentucky, Louisville Division.

According to the complaint, the plaintiff purchased her Shape-Ups in 2010 after seeing various ads that acclaimed the alleged health benefits of these shoes. While Skechers ads claimed that wearers of Shape-Ups could improve muscle tone of their legs, buttocks and abs, they also purported that wearing these shoes could help consumers get in shape without having to go to the gym.

The Skechers Lawsuit contends that after wearing her Shape-Ups daily for over a year, the plaintiff began to experience excruciating back pain around May 2011. Then, months later in October 2011, the plaintiff fell down when the rocker bottom of one her Shape-Ups rolled inwards and caused her to lose her balance. Following this fall, the plaintiff’s back pain became persistent and unbearable, causing her to seek medical attention. After undergoing an MRI, the plaintiff was informed that she had multiple bulging discs in her back and a disc fragment that had migrated. Although the plaintiff eventually underwent back surgery in July 2012, the surgery was unsuccessful, and the plaintiff continues to suffer from extreme back pain on a daily basis.

Court documents for this case go on to state that “the health risks of Skechers outweigh the absence of any benefit provided to [individuals who wear Shape-Ups]” and that the defective rocker-bottom design of Skechers Shape-Ups caused the plaintiff's injuries.

Intentionally Misleading Skechers Claims Point to Skechers Negligence
While Skechers ads touted the many health benefits that their Shape-Ups offered consumers, an independent study overseen by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf June 2010]

Skechers misrepresentation of Shape-Ups health benefits has been the basis of thousands of lawsuits filed against the company and has cost Skechers millions in settlement awards to consumers. In fact, in May 2013, a federal judge approved a Skechers $40 million settlement in a class-action Skechers lawsuit based on hundreds of thousands of consumer claims that Skechers intentionally mislead consumers in its Shape-Ups advertising. As part of this ruling, the court also found that Skechers is no longer allowed to run ads for its toning shoes.
