Da Vinci Robot Lawsuits Are On the Rise: D. Miller & Associates, PLLC Lead the Charge

D. Miller & Associates, PLLC announced it is continuing to accept clients for inclusion in a legal action seeking damages from the manufacturer of the da Vinci Robotic Surgery System. Targeted in the da Vinci lawsuit is Intuitive Surgical, Inc., the device’s manufacturer.

As reported in a CNBC article dated March 19, 2013 the da Vinci Robot continues to be used in hospitals despite increased reports detailing severe injuries allegedly sustained by patients that opt for its use during their surgery. According to the article, injuries caused by the device include “burns and other heat-related damage to intestines, ureter, bowels and other organs.”

The article also notes that training in the use of the device include “as few as two surgeries, overseen by a more seasoned robotic surgeon,” and that a “high-pressure sales culture driven by quarterly ‘quotas’ on surgical procedures has led sales people to lean on surgeons to do more robotic surgeries.”

Due to the severity and prevalence of these alleged injuries, lawsuits are being filed all around the country, says da Vinci lawyer Darren Miller of D.Miller & Associates. Intuitive Surgical, the manufacturer of the da Vinci robot, disclosed on April 19th, 2013 that at least twenty-six lawsuits have been filed relating to their da Vinci Robot (see: archive.fast-edgar.com/20130419/Aabt5znqx-xqe5C-kv-sF-p-1jN-bf-v/).

The latest suit on file is TWILA Beasley et. al v. Intuitive Surgical (No. 12 cv 2497, U.S. District Court for the Eastern District of Louisiana), filed on April 30th and closed on May 30th. TWILA Beasley echoes other suits against Intuitive Surgical, Inc. and charges it with, inter alia, products liability, negligence, fraud, and breach of express and implied warranty, according to Miller.
