According to the complaint, this case alleges that DePuy did not sufficiently test the safety of the Pinnacle Hip system’s metal-on-metal design and that DePuy failed to warn the public about the high risk of the system failing even after it had received hundreds of patient reports regarding Pinnacle Hip defects. Despite reports of Pinnacle Hip failures, the complaint points out that DePuy has continued to sell the defective hip implant without any warnings and, in so doing, has actively concealed the implant’s known defects from the public.

The complaint explains that the plaintiff underwent hip replacement surgery to have the DePuy Pinnacle System implanted in his right and left hips in September and October 2004, respectively. Following both surgeries, the plaintiff began experiencing complications that included severe pain, tenderness and difficulty walking. Due to the persistence of these painful symptoms, in September 2012, the plaintiff underwent risky revision surgery to replace the failed DePuy Pinnacle Hip in his right hip. As a result of this revision surgery, the plaintiff ended up developing a life-threatening infection in his right hip and had to undergo several additional surgeries in order to save his life. Due to his severe hip complications, the plaintiff has reportedly been living without a hip joint in his right hip since October 2012.

Pinnacle System Will Not Be Available in U.S. After August 2013
In May 2013, DePuy Orthopaedics, Inc. announced that it will slowly be phasing out the production and sale of its all-metal Pinnacle hip implant devices and that the Pinnacle will no longer be available in the U.S. by August 2013. The DePuy Pinnacle is the company’s last remaining metal-on-metal (MoM) hip implant device on the market, as the all-metal ASR hip implant device was recalled in 2010 due to findings that alleged that the device had a significantly high rate of early failure. According to DePuy, the decision to discontinue the production and sales of the Pinnacle was spurred primarily by a January 2013 FDA ruling requiring that manufacturers of metal-on-metal hip implants prove through additional clinical studies that MoM implants are safe and effective before continuing to sell them in the U.S. This FDA ruling was enacted to close an existing loophole that allows manufacturers to only demonstrate that their devices are similar to those currently available in the U.S. without having to conduct clinical testing before selling them. “DePuy has communicated to the F.D.A. its decision not to pursue further clinical studies on the Pinnacle,” DePuy officials expressed in a recent statement.
